TERMS AND CONDITIONS

Please read these Terms and Conditions carefully as failure to comply with them could invalidate any warranty supplied by INTELLI HEAT or their representatives.

1) ON RECEIPT OF YOUR GOODS

It is essential that you inspect all items before signing the delivery receipt form which will be presented to you by the carrier when your goods are delivered. Although all our products are thoroughly inspected before shipping and are properly packaged to ensure that you receive each item undamaged and in good working order, it is possible that damage may occur during transit. If you are fully confident that all your goods show no visible signs of damage, the receipt form must be signed to acknowledge your acceptance.  This will confirm that all items were received in good order without any visible damage, and in this case, any subsequent claim for items being received damaged will be dismissed.

If you discover or suspect that any item is damaged upon receipt, you must sign receipt form ‘Received damaged’ and identify the damaged item/s.  Should this be the case, you must report the issue to INTELLI HEAT immediately or at least within a maximum of 24 hours after the delivery of your goods.

Although we strongly advise you to take the time to fully inspect your goods upon receipt, we understand that this is not always convenient and in this event you must sign the receipt form ‘With Reserve’.  In this instance, you have 48 hours from the time of delivery to report to INTELLI HEAT any damage sustained in transit.

Any items returned to INTELLI HEAT as damaged must be unused, not assembled and properly and securely repackaged in their original packaging ready for collection so as to ensure the safe return to INTELLI HEAT. PLEASE NOTE: INTELLI HEAT reserves the right to refuse the repair or replacement of any item/s for reasons of visible damage should any of the above requirements not be adhered to.

It is essential that you keep your invoice, receipt and all accompanying documentation referring to your product/s. In the unlikely event that an item develops a fault, such documentation may be required in order to validate the warrantee applicable to your product/s.

2) ORDER CANCELLATION

Under current Selling Regulations customers are entitled to change your mind and ask for a refund within 7 working days of receipt of your order. The product must be in the original condition in which it was sent and must include an invoice or any paperwork sent with the item.  Any delivery charge paid will not be refunded.

You may not cancel your order once the Product has been fully or partly installed. To cancel your order you must notify us in writing. If you cancel after delivery you must return the Products within 7 working days. We will then send you a refund within 14 working days by way of a company cheque.

3) FAULT NOTIFICATION

Should a product develop a fault within the warrantee period, INTELLI HEAT reserves the right to repair or, if necessary, replace the product with – depending on availability – the same product, or if unavailable, an equivalent product. A repair or replacement will only be considered upon the receipt of a completed fault notification form (FNF) which will be sent to you.

Should INTELLI HEAT consider that a repair or replacement be necessary, collection will be arranged at our cost on a mutually agreeable date. You will be required to disconnect the item/s and to correctly pack the item/s to ensure no damage occurs during transit.

INTELLIHEAT cannot be held responsible to undertake or to cover any costs involved in, or connected to such tasks, or to re-connect/install the repaired or replacement item/s.

On receipt of the item/s reported as faulty by INTELLI HEAT, an INTELLI HEAT technician will inspect and test the item/s and investigate the installation circumstances. Depending on the nature of the fault, either the original item/s will be repaired and returned to you, or you will be provided with a replacement. Any item/s found not to be faulty or to have become faulty due to miss-use, incorrect installation, inappropriate wiring within your property, an unsuitable electricity tariff, or damage caused whilst in your possession will, if required, be shipped back to you.  However you will be liable to pay the collection and re-shipping costs plus a £70 administration fee before the item is returned to you.

If INTELLI HEAT feels that it is necessary to provide an electrician to visit your property to inspect the reported fault and the item/s is found not to be faulty, or faulty due to miss-use, incorrect installation, inappropriate wiring within your property, an unsuitable electricity tariff, or damage caused whilst in your possession, you will be charged a £250 callout fee.

4) LIABILITY

We confirm that we have the right to sell the Product to you; and is subject to your checking
that your order and installation complies with our recommendations and advice (eg restricted economy 7 its NOT recommended for our ranges) If we are liable to you for any reason, our liability will be limited to £1,000 or to the amount paid by you for the Product (if any) to which the damage relates, whichever is the lower. The limitations and exclusions in this clause apply only to the extent permitted by law. Our contract with you does not confer rights on any third party pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise. If the manufacturer is unable to source components due, for example, to a range being discontinued, there is no legal obligation on INTELLI HEAT to replace the items.
